Acceptance of these terms

These Terms of Service ("Terms") form a binding agreement between you and Kicklytics ("Kicklytics", "we", "us") and govern your access to and use of the Kicklytics website, applications, and services (together, the "Service"). By accessing or using the Service, or by creating an account, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, and "you" refers to that organization.

The Service

Kicklytics is an analytics platform that aggregates and presents publicly available data about Kick channels, streams, viewers, and categories. We surface this data as rankings, leaderboards, channel pages, comparison tools, and related analytics.

The data is collected from public sources and provided on an "as is" basis. Statistics are estimates derived from periodic sampling and may be incomplete, delayed, or inaccurate. You should not rely on them as the sole basis for any decision. We may add, change, or remove features at any time.

Eligibility and accounts

You must be at least 16 years old to use the Service. Some features require an account. You are responsible for keeping your credentials secure and for all activity that occurs under your account. You must provide an accurate email address, keep it current, and notify us promptly at the contact address below of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used unlawfully.

Subscriptions, billing, and renewals

Kicklytics offers a free tier and a paid "Pro" subscription that unlocks additional analytics features. The current price and the features included in each plan are shown on our pricing page and may change as described below.

Payments for the Pro subscription are processed by our payment provider, Dodo Payments, who acts as the merchant of record for the transaction. By subscribing, you also agree to the payment provider’s applicable terms. We do not receive or store your full card details.

The Pro subscription is billed in advance on a recurring basis for the billing period you select (for example, monthly). Unless you cancel, your subscription automatically renews at the end of each billing period and your payment method is charged the then-current price for the next period.

You can cancel at any time from your account. When you cancel, your subscription remains active until the end of the billing period you have already paid for, and it will not renew after that. Your plan then reverts to the free tier.

No refunds

All payments are final. Except where a refund is required by applicable law, we do not provide refunds or credits for any partial billing period, unused time, downgrade, or for periods during which the Service was available but unused. Cancelling stops future renewals; it does not refund the current period.

Changes to plans and pricing

We may change the features of a plan or the price of a subscription. If we change the price of your subscription, we will give you reasonable advance notice, and the new price will apply from your next billing period. If you do not agree to a price change, you may cancel before it takes effect.

Acceptable use

You agree to use Kicklytics lawfully and not to misuse it. In particular, you agree not to:

• Scrape, crawl, or systematically extract data from the Service except through interfaces we provide for that purpose.
• Resell, redistribute, or commercially exploit the Service or its data except as expressly permitted by us in writing.
• Attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the Service or its infrastructure.
• Share, transfer, or use account credentials or any access keys other than as permitted, or circumvent usage limits or access controls.
• Use the Service to infringe the rights of others or to violate any applicable law.

No affiliation with Kick; intellectual property

Kicklytics is an independent project. It is not affiliated with, endorsed by, or sponsored by Kick. All Kick trademarks, channel names, broadcasts, and content belong to their respective owners.

The Service itself — including its software, design, branding, and original content — is owned by Kicklytics and protected by intellectual property laws. These Terms do not grant you any right in our trademarks or branding.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data presented is correct or complete.

Limitation of liability

To the maximum extent permitted by law, Kicklytics and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or in connection with your use of, or inability to use, the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim, or, if you have paid nothing, zero.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to comply with law. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and governing law — will survive.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify account holders. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service shall be subject to the jurisdiction of the courts of the Republic of Türkiye, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings elsewhere.
